How Integrated Case Design and Presentation Can Benefit Your Case |

The day of the general town counsel is waning. As technology advances, and
attorneys reach further in an effort to seek specialized co-counsel and
expert testimony, increased scrutiny is placed upon case presentation in
both the war-room and the courtroom. In the past, case presentation
was valued primarily for legal content; but, today, judges, juries and other case
participants look for presentations which are appealing on numerous levels -
inclusive of content, visual design and presentation structure.

As a collection of documentation intended for a specific audience, a case meets all the criteria of published, traditional print media. It requires organization, edited content, logical content navigation, visual appeal, and bound form and/or electronic presentation. When properly addressed, each of these elements combine to create an authoritative proposal. Before I launched attorney services as an AIMS-related endeavor, I interviewed judges at the county, district and federal levels and asked them to reveal and discuss their greatest dissatisfaction in reviewing briefs and courtroom presentations. Their responses led me to include the types of services I offer. Their greatest
complaint was the habitual failure of attorneys to present information in a
consistently concise format with professionally represented exhibits. This
industry truth leads to frustrated judges who must, at worst, grapple with

Not looking for an overly dramatized presentation, these judges demonstrated deep appreciation for the intrinsic value of a case which is well-designed, well-written, and effectively communicated. As every attorney knows, integral to any case are its foundational legal principals: the facts, the law, the precedent, the argument. These principals give a case its forward momentum. A case, properly designed and presented, can not only sustain momentum, but can increase it - delivering the powerful, persuasive punch attorneys seek in positive resolution. Publishing a document, such as a brief, or an oral argument is complex and more akin to crafting a non-fiction account than simply outlining facts. As you know, facts must be illuminated. You must lead your audience to the point, while framing it within a broader context and striving to eliminate doubt. You've heard the old real-estate adage: Location, location, location. In a legal presentation, it's: Context, context, context. Once your brief is completed, and you've determined the content of your argument, AIMS can consult with you, editing your delivery for economy, consistency, clarity and force.
